By uploading images ("Submissions") to America's Top HottiesSM (the "Service") You ("You") agree to the terms and conditions of this Agreement between You and Sonic Boom, Inc.("Sonic"). If You do not agree, You are not permitted to make submissions on the Service. Sonic may change this Agreement at its discretion by posting the new terms on this site. Accessing, using or making future Submissions on the Service subsequent to the posting of the new terms constitutes acceptance of the new terms.
You must be at least 16 years of age to make Submissions. When You access, use and make Submissions to the Service, You agree to do it responsibly and only for Your own personal non-commercial use. You will not make any Submissions which are illegal, pornographic, harmful, confidential, or destructive of data or code. You will only make Submissions of yourself; that is, you are not permitted to make Submissions which contain images that are not You. You will only make Submissions for which You have a legal right. You warrant and represent that You either own or have secured all intellectual property rights in any Submissions You upload. You further warrant and represent that uploading any Submission to be used in accordance with the Service and this Agreement, will abide by the guidelines contained at http://responsibility.verizon.com/home/contentpolicy/policy and will not infringe on any third party's intellectual property rights including any rights of privacy and publicity. Be aware that Sonic personally reviews all Submissions and will reject any Submission that does not conform to your warranties made above. Sonic also reserves the right to reject any Submission for any reason whatsoever. You agree that You will defend and indemnify Sonic for any third party claims made against Sonic arising out of Your breach of this Agreement including breach of these representations and warranties. Breach of any of the terms and conditions of this Agreement gives Sonic the right to terminate the Service with no liability to You.
By making Submissions, You are granting Sonic an irrevocable, perpetual, royalty-free, sub-licensable and world-wide license to use and exploit the Submissions in any way it sees fit, including but not limited to the right to copy, sell, alter, retransmit, edit, translate, display, make derivative works of and perform in any medium or technology. Sonic may sublicense these rights to other users of the Service at its sole and absolute discretion. When Sonic or its sublicensees use your Submission pursuant to this license, You will not be entitled to any remuneration, even if Sonic receives something of value from its exploitation of your Submission.
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. THERE ARE NO EXPRESS OR IMPLIED WARRANTIES FOR THE SERVICE OR THE CONTENT CONTAINED IN THE SERVICE. DISCLAIMED WARRANTIES INCLUDE THE IMPLIED WARRANTIES OF MERCHANTIBILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. USING THE SERVICE AND MAKING SUBMISSIONS AS IT YOUR SOLE RISK. YOU AGREE THAT SONIC WILL NOT BE LIABLE FOR ANY DAMAGE ARISING OUT OF YOUR USE OF SERVICES OR MAKING SUBMISSIONS.
